These Terms of Use ("Terms") govern your use of the PhotoNest Backup iOS app ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service.
2. Your NAS and your responsibility
PhotoNest Backup is a tool that copies photos and videos from your device to a Synology NAS that you own and control. You are responsible for your NAS, your network, your credentials and the integrity of the data stored on it. The app is not a substitute for maintaining your own independent backups, and we do not guarantee that every item will transfer without error. Please verify your backups.
3. Subscriptions and billing
Some features are part of an optional subscription, PhotoNest Pro, offered as an auto-renewable monthly or yearly subscription and as a one-time "Lifetime" purchase.
- Payment is charged to your Apple Account at confirmation of purchase.
- Auto-renewable subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period.
- You can manage or cancel your subscription any time in your Apple Account settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current paid period.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Prices are shown in the app and may vary by region and change over time.
4. Acceptable use
You agree not to misuse the app, interfere with its operation, reverse engineer it except as permitted by law, or use it to violate any applicable law or the rights of others.
5. Disclaimer of warranties
The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will prevent data loss.
6. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from your use of or inability to use the app.
7. Apple's standard license terms
Your use of the app is also subject to Apple's Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula, which is incorporated into these Terms by reference.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the app constitutes acceptance of the updated Terms.
